Examples of my experience and success:
Anti-Slapp litigation. Successful in Berkshire Superior Court in obtaining not only a dismissal of a case against my client for interference with advantageous/business relations, but was awarded my legal fees in the process.
93A and other litigation. Successful in collecting against various building contractors for malfeasance. Successful on Motion for Summary Judgment for defendant/developer against claims of misrepresentation and breach of contract.
Bankruptcy litigation. Successfully obtained Judgment in Berkshire Superior Court and collected, despite Defendant’s bankruptcy filing.
Collection litigation. Successful in various suits, primarily in Berkshire District Courts, to collect fees for clients for their services. In one case, jury asked to award my client legal fees because of my efforts.
Nuisance litigation. Successful in enjoining nuisances.
Divorce/custody/support litigation. Successful in Probate Court helping average people balance the scales and effectuate fair settlements.
Estate litigation. Successful in compelling the proper administration of estates in Berkshire Probate Court.
Eminent Domain. Involved in eminent domain and development issues.
Land use. Successful in having Superior Court zoning case dismissed for lack of standing (although overturned on Appeal). Successful in having decision of building inspector upheld by local zoning board. Involved with various zoning issues, including expansion of pre-existing, non-conforming uses. Some experience with state and federal environmental permitting. Successful in litigation compelling payment for use of easement. Involved in several boundary line issues which were resolved by agreement.
Development. Represented developer in construction and sale of 11 condominium units. Involved in planning for redevelopment of historic area, including helping to draft overlay district to promote such redevelopment. Overseeing planning and obtaining permits for major repairs to large historic structure.
Preservation. Represented clients in appraisal and transfer of Agricultural Preservation rights.
Legislation. Drafted Sherwood Greens Road Improvement and Maintenance District legislation. Proposed and promote legislation to tax non-profit organizations that charge for their services. Advocate for state single-payer legislation.
